1. Acceptance of Terms
These terms form a binding agreement between you and DMB Contractors LLC. You accept them by accessing the website, by sending an enquiry through the contact form, by email or by telephone, or by booking a fit bay or related service. If you act on behalf of a company or another person, you confirm that you have authority to bind that party to these terms. These terms apply in addition to any signed proposal, booking sheet or work order that the parties may agree. Where a signed document conflicts with these terms, the signed document controls for the specific matter it addresses.
2. Definitions
In these terms, the words below have the meanings given. The company means DMB Contractors LLC. The client means the person or business that books or receives a service. The website means all pages under the shundashipping.autos domain. A fit bay means a reserved station in the Cedar City workshop where a cabinet run is prepared, fitted, levelled, punched and walked. A run means a defined group of cabinets, doors and fillers that is handled as one unit. A hinge schedule is the written pattern that sets cup centres, overlay and swing for each door. A punch list is the written record of open items before handover. A final walk sitting is the closing review attended by the client.
3. The Services We Provide
DMB Contractors LLC provides cabinet fitting services built around six booked windows: Fit Bay Bookings, Hinge Schedule Runs, Punch List Desks, Level Check Windows, Trim Color Reviews and Final Walk Sittings. The company also provides computer systems design and related professional and technical services as described on the services page. The scope of any particular engagement is set out in the booking sheet or written proposal for that engagement. Anything not described in the booking sheet is outside the scope. If the client asks for additional work during an engagement, the company may agree to it in writing, and the terms of that addition will be recorded on an updated sheet with any change to price or timing.
4. Bookings and Scheduling
Bookings reserve a bay, a bench and a level rail for a named run across a defined window. Bookings are confirmed only when the company issues a written confirmation. Until then, a requested date is provisional. The client should send delivery dates as early as possible, together with the door and drawer count and any known dependencies such as countertop templating. The company may adjust a booking where a dependency is not ready, and will discuss the alternatives before moving a date. Where a run arrives later than the booked window, the company will try to hold the bay but cannot promise to do so if another booking is already confirmed for the following period.
5. Client Responsibilities
The client agrees to provide accurate information about the project, to make decisions when they are needed, and to ensure that people who must attend a booking or a final walk are available at the arranged time. The client is responsible for supplying goods that the company has not agreed to supply, such as cabinetry, hardware or countertop material, in a suitable condition and on time. The client is also responsible for obtaining any consent required to allow work to proceed, such as building approval or landlord permission. Where the client supplies drawings, the company is entitled to rely on them unless the company has agreed in writing to verify them independently.
6. Measurements and Site Conditions
Cabinet fitting depends on tolerances. The company will take the measurements it needs for the work it has agreed to perform, but it does not survey the whole building unless the booking says so. Site conditions such as out of square walls, uneven floors, hidden services and prior damage can affect the fit and may require additional work. Where the company identifies a condition that was not reasonably visible at booking, it will tell the client and agree how to proceed. The client acknowledges that timber products move with changes in humidity and temperature, and that small seasonal movement is normal in built-in cabinetry.
7. Level Checks and Tolerance
A level check window is used to measure the run against the level rail and the floor datum, at the front edge and the back edge, before the countertop is set. Readings are recorded on the bay sheet. The company works to the tolerance stated in the booking sheet or, where none is stated, to a reasonable cabinet fitting tolerance appropriate to the run. Where the site requires a shim plan, the plan is recorded so that the toe kick and trim reveal can cover it cleanly. A level check is a measurement and record service. It does not certify the structural condition of the floor, the wall or any other part of the building.
8. Hinge Schedules and Hardware
The company runs each door against the approved hinge schedule before it is hung. Cup centres, overlay and swing direction are checked on the jig, and doors that miss the pattern are corrected on the bench. Where the hardware is supplied by the client, the company is entitled to rely on the stated specification and on the supplied quantities. Where the company recommends a hinge type, the recommendation is based on the door weight and opening described in the booking, and a later change to the door or the opening may require a different pattern. Marking each completed door with the bay letter and date allows a later replacement to be matched to the original schedule.
9. Punch Lists and Rework
The punch desk records every open item, assigns it to a named person and closes it with a signature, a photograph or a corrected part number. Worked items are re-read at the bay at the end of the day. Where an item is caused by work performed by the company, the company will correct it at no additional charge. Where an item is caused by a third party, by client supplied goods or by a site condition outside the agreed scope, the company will discuss the correction with the client and any additional cost before proceeding. Punch lists are not a substitute for the client raising a concern during the engagement, and the company encourages prompt feedback at the bay while a cabinet is still clamped.
10. Trim and Finish Approvals
Trim and fillers are reviewed under the bay lamp against the actual run, not only against a sample chip. The approved shade is recorded by code and batch so that a later touch up or replacement can be matched. The client is responsible for attending the review or for nominating someone to attend on the client behalf. Where a review is waived in writing, the company will use the shade specified in the booking sheet, and the client accepts that natural variation between batches may be visible. Finish approvals are final once the trim is fixed, unless a defect is found that falls within the warranty described below.
11. Final Walk and Handover
The final walk sitting is the closing review. The client walks the completed run door by door and drawer by drawer with the punch sheet in hand. The walk closes with a signed handover note and a dated list of any agreed follow up items. Once the note is signed, the bay is released for the next booking and the run record is filed. The company asks the client to inspect the run carefully at this point, because it is the last opportunity to raise a preference while the run is still in the workshop. Signing the handover note does not remove rights that the client has under the warranty or under applicable law.
12. Pricing and Payment
Prices are set out in the booking sheet or written proposal. Unless the document states otherwise, prices are quoted in United States dollars and exclude any tax that the law requires to be added. A booking may require a deposit to hold the bay, and the balance is due according to the schedule in the booking sheet. Where the scope changes, the company will issue an updated sheet showing the effect on price and timing before the additional work begins. Invoices are payable within the period stated on the invoice. The company may suspend work where an undisputed invoice remains unpaid after a reminder, and will give the client reasonable notice before doing so.
13. Cancellation and Rescheduling
A fit bay is a reserved resource, so cancellation and rescheduling terms are set out in the booking sheet. Where a client cancels with reasonable notice, the company will refund any deposit that has not been used for materials, supplier commitments or work already performed. Where a cancellation is made at short notice, the company may retain the deposit to cover the lost bay time, up to the amount of the loss. Rescheduling is usually possible where another window is free, and the company will try to accommodate it. If the company must cancel for a reason within its control, it will refund any unused deposit and offer the earliest available alternative window.
14. Workmanship and Warranty
The company warrants that its fitting work will be performed with reasonable skill and care. If a defect in workmanship appears within the warranty period stated in the booking sheet, the company will correct it at no additional charge, provided the client reports it promptly and gives reasonable access to inspect and repair. The warranty does not cover damage caused by misuse, accident, neglect, alteration by others, normal wear, movement of timber beyond reasonable seasonal variation, or goods supplied by the client. Where no warranty period is stated in the booking sheet, a reasonable period applies having regard to the nature of the work. This warranty is in addition to any rights that cannot be excluded by law.
15. Limitation of Liability
To the fullest extent permitted by law, the company is not liable for indirect, incidental, special, consequential or punitive loss, or for loss of profit, loss of revenue, loss of opportunity or loss of goodwill, however arising and whether or not the possibility of such loss was known. The company is not liable for loss caused by third parties, by client supplied goods or by site conditions outside the agreed scope. The total liability of the company for any claim arising out of or relating to an engagement is limited to the amount paid by the client for the specific service giving rise to the claim. Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or for death or personal injury caused by negligence.
16. Indemnity
The client agrees to indemnify and hold harmless the company, its members, employees and agents from any claim, loss, liability or expense arising out of the client breach of these terms, the client failure to obtain a required consent or approval, the client supply of inaccurate drawings or specifications, or the client supply of goods that are unsafe or not fit for their intended use. This indemnity does not apply to the extent that the claim is caused by the company own negligence or wilful misconduct. The company will give the client reasonable notice of any claim it becomes aware of that may fall within this section.
17. Intellectual Property
The website, its text, its layout, its stylesheets and its scripts are the property of the company or its licensors and are protected by copyright and other laws. The company grants the client a limited, non exclusive, non transferable licence to view the website and to print pages for personal or internal business use. The client may not copy, republish, frame, scrape or create derivative works from the site without written permission, except as the law allows. Drawings, schedules and workshop records prepared by the company for a client engagement remain the property of the company unless the booking sheet states otherwise, but the client may use them for the project they were prepared for.
18. Acceptable Use of the Website
You agree not to use the website in a way that is unlawful, that interferes with its operation, or that harms another person. You may not attempt to gain unauthorised access to any part of the site or to any system connected to it, and you may not introduce malicious code, run automated scraping at a volume that burdens the service, or misrepresent your identity when contacting the company. You may not use the contact form to send spam, chain messages or content that is defamatory, abusive or infringing. The company may suspend access where it reasonably believes the site is being misused, and may report unlawful activity to the appropriate authorities.
19. Privacy
The company handles personal information in accordance with its Privacy Policy, which forms part of these terms by reference. The Privacy Policy explains what information is collected, how it is used, how long it is kept and what rights you have. It also explains that the contact form opens your own email program rather than sending data to a third party form service. You can read the Privacy Policy using the link in the footer of every page. By using the website and by sending information to the company, you acknowledge the practices described in the Privacy Policy.
20. Third Party Materials
The website may contain links to third party sites or refer to third party products such as hinges, fillers and countertop materials. Those materials are provided for convenience and information only. The company does not control third party sites and does not endorse every statement made on them. Where the company refers to a product specification supplied by a manufacturer, the client should confirm the specification with the manufacturer before relying on it for a critical decision. Any warranty on a third party product is provided by that party and not by the company.
21. Events Beyond Our Control
The company is not liable for a delay or failure to perform that is caused by an event beyond its reasonable control. Such events include severe weather, wildfire, flood, earthquake, epidemic, government action, labour disruption, failure of a utility or transport network, and shortage of a material that could not reasonably have been anticipated. Where such an event occurs, the company will notify the client as soon as practicable and will work to reschedule the affected booking. If the event continues for an extended period, either party may end the affected engagement, and the company will refund any amount paid for work that has not been performed.
22. Governing Law and Disputes
These terms are governed by the laws of the State of Utah, without regard to its conflict of laws rules. The parties agree to try to resolve any dispute by discussion in good faith before starting formal proceedings. If a dispute cannot be resolved by discussion, the parties agree that the courts located in Iron County, Utah, will have jurisdiction, unless applicable law requires a different forum. Nothing in this section prevents a party from seeking urgent relief to protect its rights. Where a dispute concerns an amount that is small, the parties are encouraged to use a recognised mediation service before filing a claim.
23. Changes to These Terms
The company may update these terms from time to time. When it does, the date at the top of this page will change. If a change is significant, the company will take reasonable steps to bring it to the attention of clients with an active booking or an open enquiry. Changes apply to use of the website from the date they take effect. Changes do not alter the terms of a booking that was already confirmed, unless the parties agree in writing. Continued use of the website after a change takes effect means that you accept the revised terms to the extent the law allows.
24. Contact Information
Questions about these terms, a booking or a service can be sent to the company at the address below. Please include enough detail for the company to identify the relevant records and to reply promptly. The company welcomes the chance to resolve a concern before it becomes a dispute, and it will do its best to respond within a reasonable time.

Thank you for reading these terms. The fit bay runs on clear records, named responsibility and plain communication, and these terms are written to match that way of working. We look forward to handling your cabinet run with the same care that the workshop applies to every hinge schedule and every final walk.
